Update: Aurizon's attempt to terminate enterprise agreements

I refer members to the RTBU circulars dated, 12/5, 23/5, 5/6 and 13/6 on the above matter.

Aurizonís determination to strip conditions from workers in any manner available continues with their push towards termination of the agreements. The RTBU believes that Aurizon is unlikely to be successful with this avenue of attack on their employees, but we will be using all the necessary legal means to challenge this.

As I advised in a previous circular this matter has been referred to the full bench and Fair Work has now advised that another directions hearing on Wednesday before the Fair work Vice-President to address some issues identified by the legal teams. The Full bench initial hearing will not take place to late next month, that being the 25 July 2014.

Regardless of this, the Unions will not be in anyway intimidated by this disgraceful tactic and will continue with our attempts to secure Agreements with Aurizon through this particular mechanism and have sought further discussions with Aurizon which we understand will occur on Thursday, this week.

I shall ensure members are advised of all developments in this respect.
